RAJ MOHAN SINGH, J. (ORAL) Learned counsel for the respondent submits that an amount of Rs.8,000/- per month was assessed as maintenance by the Family Court. The maintenance was being received from the authority but the appellant has deserted the Army and, thereafter, Army Authorities have stopped payment of monthly maintenance. Perusal of interlocutory orders on record would show that the learned counsel for the appellant is consistently making default in appearance since 03.08.2022. On the last date of hearing i.e. 23.03.2023, there was no representation on behalf of the appellant despite repeated pass overs. Even the date was ordered to be notified to the learned counsel for the appellant. Appellant was also directed to remain present in Court today. Neither the Advocate on NEHA 2023.08.03 12:31 I attest to the accuracy and integrity of this order/judgment

In view of the aforesaid position, this Court has no alternative but to dismiss this appeal for non-prosecution. Ordered accordingly.
