(ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.114 dated 20.07.2024 under Sections 331(6), 115(2), 351(2), 191(3), 190 of the Bharatiya Nagarik Sanhita, 2023, registered at Police Station Sardulgarh, District Mansa.

Vide order dated 05.09.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel, at the outset, has drawn the attention of this Court to the FIR, which has been annexed as Annexure P-2, and submitted that a perusal of the same clearly reveals that although he was named therein and was alleged to be armed with a stick, however, other than his presence being shown at the place of occurrence, no role much less any injury had been attributed to him; it was coaccused who had been attributed the injuries on the person of the complainant."

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 05.09.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
