The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.405, dated 25.9.2014, Police Station Sadar Nakodar, District Jalandhar City, under Sections 457 and 380 of Indian Penal Code.

The FIR was lodged at the instance of Varinderjit Singh, wherein it is alleged that on the night intervening 17.9.2014 and 18.9.2014, some unknown person had entered into their house and had stolen a gas cylinder. The complainant suspected that the same had been stolen by Sunny @ Tata and Lovepreet Singh.

Learned counsel for the petitioner submits that the petitioner has been named in the FIR without there being any evidence to support the same and that, in PANKAJ KAKKAR 2022.10.21 17:49 I attest to the accuracy and authenticity of this document
( 2 ) CRM-M-48239-2022 (O&M) any case, since the petitioner has been behind bars for the last about 3 years and 7 months, he deserves the concession of bail. 4.
Opposing the petition, the learned State counsel has submitted that the petitioner is a habitual offender having been involved in 5 other cases and had remained proclaimed offender in the instant case after having put in appearance before the Court and in these circumstances, he does not deserve the concession of bail.

This Court has considered the rival submissions. 6.
There are indeed specific allegations against the petitioner. The petitioner had also been declared a proclaimed offender and it was on 30.1.2020 that he was arrested by the police and ever since he has been behind bar. Having regard the nature of offence and keeping in view the long custody of the petitioner, this Court is of the opinion that further detention of the petitioner would not be justified. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
