NIDHI GUPTA, J. (ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 167 dated 16.12.2022 registered under Sections 376 and 376(2)(n) IPC and Sections 6 and 8 of the Protection of Children from Sexual Offences Act, 2012 (Sections 67, 67A and 67B of the IT Act were added later on) at Police Station Nangal, Rupnagar.

Learned counsel for the State has filed custody certificate dated 05.10.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 09 months and 19 days.

After arguing for some time when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
