PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.125 dated 09.09.2022 registered for the offences punishable under Sections 349-B and Section 411 of the Indian Penal Code, at Police Station Goraya, Jalandhar. 2.

Ld. Counsel for the petitioner submits that it is a case wherein the complainant who is working with the petitioner has accused him of snatching the mobile and fifty rupees. Counsel submits that both are working as labour and had an altercation on some issue which has resulted in false implication of the petitioner. He, thus, submits that it is not a case wherein the petitioner can be said to be a habitual snatcher and the same is evident from the fact that there is no other case pending against him. The petitioner is in custody since 9th of September, 2022. He further submits DEEPAK KUMAR 2022.10.21 16:58 I attest to the accuracy of this document

CRM-M-48005-2022 -2that no bill of mobile has been produced by the complainant to substantiate the allegation of snatching of mobile.

Ld. State Counsel does not dispute the aforesaid factual assertions made by counsel for the petitioner based on record. 4.

In view of the aforesaid fact and keeping in view the incarceration already suffered by the petitioner, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the Trial Court/Duty Magistrate, concerned.
