Dis-satisfied with the quantum of compensation granted by the tribunal, injured-claimant has preferred the instant appeal. Learned counsel submits that appellant sustained serious injuries in the accident. He is, thus, entitled to higher compensation keeping in view the facts and circumstances of the case. I have heard learned counsel for the appellant. An accident occurred on 09.12.2008 in which appellant sustained injury in a motor vehicle accident on account of rash and negligent driving by respondent no. 1. On a claim being lodged, tribunal came to the conclusion that accident had taken place due to rash and negligent driving by driver of the offending vehicle. Tribunal after taking into account disability certificate to the extent of 20% granted a sum of `40,000/- towards it.
Another sum of `20,000/- was granted on account of pain & suffering etc. Total compensation was, thus, worked out as `60,000/-. In my considered view compensation has been correctly computed by the tribunal. Learned counsel for the appellant has not been able to point out any defect in the Ajay Kumar 2017.05.
FAO No. 3545 of 2012 appreciation of evidence by the tribunal. Accordingly, I find no ground to interfere in appellate jurisdiction of this court. Appeal is without any merit and is hereby dismissed.
