**** RAJ MOHAN SINGH, J.(Oral) Learned counsel for the appellant submits that the present appeal has been preferred by the appellant-wife against the judgment and decree dated 04.01.2017 passed by the Additional District Judge, Amritsar vide which the petition under Section 13 of the Hindu Marriage Act filed by the appellant-wife was dismissed.
During pendency of the present appeal, both the parties PRINCE SAINI 2023.09.14 23.48 I attest to the authenticity and integrity of this order/judgment
FAO-M No.62 of 2017(O&M)
have amicably settled their differences and as a result of that, a joint petition under Section 13-B of the Hindu Marriage was filed before the Family Court for grant of a decree by mutual consent. The said petition has already been accepted by the Family Court.
In view of the aforesaid development, learned counsel for the appellant submits that the appellant is no more interested in pursuing this appeal and the present appeal may be dismissed as withdrawn.
Ordered accordingly.
Office of learned counsel for the respondent be informed accordingly. Liberty is granted to the respondent that in case, the statement of fact as made by the learned counsel for the appellant ultimately found to be untrue, then the respondent would be at liberty to move an appropriate application for revival of this appeal.
