This petition is filed for grant of regular bail in FIR No. 611, dated 26th August, 2021, under Sections 307 and 34 IPC (Section 308 IPC deleted during investigation), registered at Police Station Old Industrial, Panipat.

As per the case set up, on the intervening night of 15th/16th August, 2021, there was an altercation between Mohan Sharma, complainant, and Rajdeep (petitioner). Petitioner gave a blow with handle of hand-pump, on the head of the complainant. 3.

Learned counsel for the petitioner submits that the petitioner is in custody since 22nd September, 2021, investigation is complete, the material witnesses, i.e. the complainant and eye witnesses have been examined and declared hostile.

Learned State counsel, on instructions, opposes the prayer. 5.

CRM-M-52295-2021 (O&M) investigation is complete, material prosecution witnesses have already been examined, conclusion of trial is likely to take time, and the petitioner has no criminal antecedents, the petitioner is granted bail subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/ Duty Magistrate concerned.

This petition is allowed.

It is clarified that observations made here-in-above shall not be construed as an expression of opinion on the merits of the case. 8.

Needless to say that in case there is a misuse of the concession of bail the State would be at liberty to avail the remedies in accordance with law.

Pending miscellaneous application stands disposed of accordingly.
