NIDHI GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for quashing of FIR No. 0147 dated 10.09.2018 (Annexure P-1) registered under Sections 323, 341 and 149 IPC (Section 376 IPC was added later on) at Police Station City-I, Abohar, District Fazilka and all other proceedings arising therefrom on the basis of compromise dated 14.02.2019 (Annexure P-2).

Perusal of the file shows that vide order dated 24.02.2020, passed by a co-ordinate Bench of this Court, the parties were directed to record their statements qua genuineness of compromise dated 14.02.2019 (Annexure P-2) and thereafter, last opportunity was also granted to the parties to do the needful, vide order dated 18.05.2023, but statements of the parties could not be recorded, till date. CRM-M-42062-2019 -2Even there is no representation on behalf of respondent No. 2, thus, it is clear that no compromise is subsisting between the petitioners and respondent No. 2 herein.

On instructions from ASI Randhir Singh, learned counsel for the State has informed that after completion of investigation in the present case, the police had prepared the cancellation report on 04.12.2021 and presented before the learned Illaqa Magistrate on 28.11.2023 and the same is yet to the accepted. In view of the above, learned counsel for the petitioners submits that he may be permitted to withdraw the present petition. Permitted to do so.

Dismissed as withdrawn.
