(Oral) Learned counsel for the petitioner very fairly submits that during the pendency of the present petition, learned trial Court has framed the charges on 18.01.2023 and therefore, he be permitted to withdraw the present petition, as he wishes to challenge the order of charge independently, in accordance with law. He further prays that the only reason he has been entangled in this litigation is that he is serving as police official and prays that his personal appearance be exempted in the proceedings.

After hearing learned counsel for the petitioner, the present petition is dismissed as withdrawn. However, the trial Court is requested to take a lenient view, in case, the petitioner prays for exemption from personal appearance on each and every date, however, he shall be bound to appear as and when called by the learned Court below.
