The State is in appeal seeking reduction in the amount of compensation awarded to the landowners by the learned court below for the acquired land.

Briefly, the facts of the case, as are evident from the record, are that State of Haryana vide notification dated 30.5.2005, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act') sought to acquire land, situated in village Jaroda Had Bast No. 403, Tehsil Jagadhri, District Yamuna Nagar for development and utilisation thereof as residential and commercial area for Sectors 22, 23 and 24 Part, Jagadhri. The same was followed by notification issued under Section 6 of the Act. The Land Acquisition Collector (for short, 'the Collector'), vide award dated 16.7.2007, assessed the market value of the acquired land. Aggrieved against the award of the Collector, the land owners filed objections which were referred to the learned court below, who keeping in view the material placed on record by the parties, determined the fair value of the acquired land @ ` 1,560/- per square meter.

Learned counsel for the State very fairly submitted that other appeals filed by the State arising out of acquisition vide same notification SHARMILA 2015.10.20 16:19 I attest to the accuracy and authenticity of this document.

RFA No. 5096 of 2014 (2) for the same purpose, have been dismissed by this Court vide order dated 22.9.2014 passed in RFA No.7443 of 2014-State of Haryana and another v. Ramesh Kumar and others.

For the reasons stated in Ramesh Kumar's case (supra), the present appeal is dismissed.
