Through the instant writ of habeas corpus, the petitioner seeks release of his wife/alleged detenue Reena Kaur, aged about 19 years, from the illegal custody of respondents No.4 to 6. 2.

This Court, while issuing notice upon the instant petition on 03.09.2024, had directed the S.H.O. concerned to locate the alleged detenue and thereupon get her statement recorded under Section 183 of the B.N.S.S. before the learned Magistrate concerned. 3.

Today, a report has been received from the Chief Judicial Magistrate, Barnala, through proper channel, which is taken on record. A perusal of this report reveals that, the alleged detenue was produced before the learned Magistrate on 05.09.2024, whereupon, the learned Magistrate got vacated the Court Room before recording her statement. After becoming satisfied that the alleged detenue is making the statement DEVINDER YADAV 2024.09.13 09:01 I attest to the accuracy and authenticity of this order/judgment

CRWP-8545-2024 voluntarily, the learned Magistrate concerned recorded her statement under Section 183 of the B.N.S.S. In her statement, the alleged detenue stated that she wants to live with her parents, as she apprehends danger to her life at the hands of her in-laws' family. Consequently, the learned Magistrate concerned directed the I.O./Insp. Jagjit Singh to hand over the safe custody of the alleged detenue to her parents and this direction was complied with.

In view of the disclosures made in the report (supra), which is accompanied by statements of the alleged detenue and the I.O., no further directions is required to be passed upon the instant petition. 5.
