(Oral) The learned State counsel has informed that all the prosecution witnesses stand examined and that the matter is now fixed for recording the statement of the accused in terms of Section 313 Cr.P.C. Faced with the aforestated position, the learned counsel representing the petitioner submits that he may be permitted to withdraw the petition at this stage with liberty to file afresh in case there is delay in conclusion of trial.

In view of the aforesaid submission, the petition is dismissed as withdrawn with liberty aforesaid.
