The instant petition is for seeking parole by the petitioner, who has been convicted and sentenced for life imprisonment. 2.

It is stated that his wife is pregnant and she needs his care and attention.

Reply filed on behalf of the respondent - State, where it is submitted that emergency parole for the said reasons is not available under the Act. However, this Court finds that the petitioner, who is undergoing life imprisonment, is otherwise entitled to regular bail. The ground for rejecting his parole application is only that he is likely to abscond. However, considering the fact that the petitioner is having family, we do not agree with such an apprehension being raised by the concerned police officials, who are expected to perform their duties cautiously.

CRWP-8828-2024 - 2 - Besides, it is also noticed that the petitioner had earlier been released on parole vide order dated 18th April, 2023, which was not misused by him. Thus, there is no allegation of misusing the parole earlier granted to him.

Accordingly, we grant this petition for seeking parole and direct the petitioner to be released on parole as per rules, for a period of four weeks as prayed, after taking the appropriate surety bond(s) to the satisfaction of the concerned Duty Magistrate or any other concerned authority. Petition stands disposed of accordingly.
