Prayer in this petition is for modifying the impugned award dated 26.04.2018 passed by learned Motor Accidents Claims Tribunal, Sirsa and in place of a compensation of Rs.10,12,800/- along with interest @ 9% from the date of filing of petition till realization and amount of Rs.50 lacs along with interest @ 12% from the date of the application till realization. 2.

Notice has not yet been issued in this case. The case has been adjourned either at the request or non-appearance of learned counsel for the appellants since 2019.

On the last date hearing i.e. 10.01.2023, the following order was passed.

"The present appeal pertains to the year 2018 which is still at the stage of preliminary hearing. The case has been repeatedly adjourned either on the ground that none had appeared on behalf of the appellants or on the request of learned counsel for the appellants. Today, a request for an adjournment has been PARVINDER SINGH 2025.05.08 10:21 I attest to the accuracy and authenticity of this order/judgment

FAO No. 6798 of 2018 (O&M) made on behalf of arguing counsel for the appellants on the ground that he is unwell. In the interest of justice, adjourned to 22.05.2023. It is made clear that no further adjournment shall be granted and in case the appeal is not argued on the next date of hearing, a legal aid counsel shall be appointed for the appellants to assist this Court."

Even today, none appears on behalf of the appellants. Accordingly, the petition is dismissed for non-prosecution. 5.
