Counsel for the complainant submits that on the last date of hearing, this Court had directed the petitioner to remain present in Court and in case he failed to appear, this present petition might be dismissed for non-prosecution. Today, neither the petitioner nor his counsel are present. Counsel for the complainant submits that the petitioner is not present for the reason that he has absconded and travelled abroad without any the permission of the Court. This is why his counsel is also not appearing. Be that as it may, since the previous order has not been complied with, the present petition is dismissed for non-prosecution. However, liberty is reserved to the petitioner to file a fresh petition supported by the affidavit of the petitioner himself.
