The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of letter dated 09.05.2023 (Annexure P-1) whereby passport authority has proposed to impound his passport.

The petitioner was issued passport on 25.04.2023 and it is valid upto 24.04.2033. The respondent on the basis of police verification report vide communication dated 09.05.2023 (Annexure P-1) has called upon the petitioner to show cause as to why action should not be taken against the petitioner in terms of Section 12 (1) (b) of the Passport Act and passport be impounded.

Learned counsel for the petitioner inter alia contends that passport authority has proposed action against the petitioner on the basis of ANJU GOEL 2023.09.14 18:37 I attest to the accuracy and integrity of this document

CWP-20316-2023 -22023:PHHC:120893 FIR No.39 dated 04.05.2019, registered at Police Station Division No.1, under Sections186, 353, 389 and 506 of IPC. The police after completing investigation has found the petitioner innocent, however, cancellation report is yet to be filed.

Learned State counsel on instructions from ASI Nirmal Singh asserts that the petitioner during investigation has been found innocent, however, cancellation report is yet to be filed. 5.

Learned counsel for respondents No.1 to 3 submits that passport authority would pass an appropriate order after considering statement of learned State counsel as well as reply dated 25.07.2023 filed by the petitioner to the aforesaid show cause notice. 6.

In the wake of statement of learned counsel for the respondents, the petition stands disposed of with a direction to passport authority to consider present status of FIR as well as reply filed by the petitioner.
