Prayer in the instant petition is for grant of anticipatory bail to the petitioner in case FIR No.65 dated 12.03.2024 under Sections 307, 506, 148 & 149 of the Indian Penal Code, 1860, and Section 25 of the Arms Act, registered at Police Station Mataur, District S.A.S. Nagar (Mohali), Punjab.

On the last date of hearing i.e. on 05.09.2024, while noticing the following submissions made by the learned counsel for the petitioner, a Coordinate Bench of this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- "Learned counsel for the petitioner inter alia submits that the petitioner has not been named in the FIR. Only allegation against the petitioner is that he is one of the friends of the co-accused in the FIR. No injury has been attributed to the petitioner. He further submits that co-accused namely Harpreet Singh @ Pita has already been granted concession of interim bail by this Court in CRM-M-39258-2024 on 13.08.2024."

Learned counsel for the petitioner submits that in compliance of order dated 05.09.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Status report by way of affidavit of Sh.Jayant Puri, IPS Assistant Superintendent of Police (City-I), District SAS Nagar, has been filed by learned State counsel on behalf of respondent-State in Court today. The same is taken on record subject to all just exceptions. 5.

Learned State counsel, on instructions from ASI Kesar Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. It has also not been disputed that the petitioner has not been attributed any specific role much less injury in the occurrence in question. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 05.09.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
