The present petition has been filed under Section 439 Cr.P.C. for the grant of regular bail in FIR No.48 dated 01.05.2019 registered under Section 21 of the Narcotic Drugs and Psychotropic Substance, 1985 at Police Station Sherpur, District Sangrur.

Learned counsel for the petitioner submits that the petitioner, who is a lady, has been falsely implicated in the present case; she has been in custody for the last over 01 year and 04 months; there is no other criminal case in which the petitioner is involved and the trial in which till date none of the 12 prosecution witnesses has been examined is likely to take a long time to conclude especially in the present circumstances when the world is facing the Covid-19 pandemic.

CRM-M-41414-2019 -2that 300 strips of 10 tablets each of Clovidol-100 were recovered from the illegal possession of the petitioner.

The petitioner is a lady; there is no other criminal case in which she is involved; she has been in custody since 01.05.2019; till date none of the 12 prosecution witnesses has been examined; for the last about six months the trial has simply been adjourned due to Covid-19 pandemic and due to the prevalent situation the trial is not likely to conclude in the near future.

In view of the above, the present case is considered to be a fit one in which the petitioner be directed to be released on regular bail. Resultantly, subject to the satisfaction of the CJM/Duty Magistrate, Sangrur, the petitioner is directed to be released on bail. It is clarified that the above observations have been made only for the limited purpose of deciding the present regular bail application and the same would not be construed to be an expression of opinion on the merits of the case.
