(ORAL) By way of present petition filed under Section 482 Cr.P.C., prayer has been made for quashing of order dated 02.08.2022 passed by learned Judge, Special Court, Kapurthala, whereby, on account of non-appearance of the petitioner, his bail bonds were cancelled and surety bonds forfeited. On 18.10.2022, this Court passed the following order:- "Learned counsel for the petitioner has submitted that vide order dated 02.08.2022, the bail bonds and surety bonds of the petitioner have been cancelled by the learned trial Court on the ground that he could not appear on that date. He further submitted that it was due to miscommunication of date by the lawyer and it was his first non-appearance and he was not a habitual in non-appearance. He also submitted that on the very first date the bail bonds and surety bonds of the petitioner have been cancelled. Learned counsel for the petitioner has further submitted that he has instructions to say that the petitioner will now surrender before the learned trial Court within a period of 3 weeks from today.

Notice of motion.

Mr. Amit Rana, Sr. DAG, Punjab accepts notice on behalf of the respondent/State.

In view of the undertaking given by the learned counsel for the petitioner on behalf of the petitioner, the SONIKA 2023.01.10 17:28 I attest to the accuracy and authenticity of this document

CRM-M-48347-2022 --2-- petitioner is directed to surrender before the learned trial Court within a period of three weeks from today. Adjourned to 09.01.2023.

Till the time the petitioner surrenders before the learned trial Court, no coercive steps shall be taken against him.

Thereafter, in case the petitioner files any application for bail then the same shall be decided by the learned trial Court preferably within a period of three days." In compliance of the aforesaid order, the petitioner surrendered before the Judge Special Court, Kapurthala and was granted the benefit of bail, subject to furnishing of his bail bonds/surety bonds vide order dated 09.11.2022.

In view thereof, once the petitioner has already put in appearance before the trial court, and has been granted the benefit of bail, no further orders are required to be passed in this petition. Disposed of accordingly.
