After arguing the appeal at some length, learned counsel for the appellant contends that he be permitted to withdraw the instant appeal with liberty to take up all the pleas, that he has raised herein, before the competent authority who may be seized of the proceedings to declare the land in occupation of respondent No.4 as shamlat. He, however, contends that costs of ` 30,000/-, that has been imposed upon him, be reconsidered.
After hearing learned counsel for the appellant and noticing the limited prayer made before us, we deem it appropriate to waive off the costs imposed considering that no malafide is apparent in the approach of the appellant in pursuing his cause.
