This is an application under Section 151 CPC for restoration of the contempt petition which was dismissed on 24.02.2025. 2.

For the reasons stated in the application which is supported by an affidavit, the application is allowed and the order dated 24.02.2025 is recalled and the contempt petition is ordered to be restored to its original number.

Main case 1.

This is a petition filed under Section 12 of the Contempt of Courts Act, 1971 for non-compliance of the order dated 26.02.2024 passed by the Co-ordinate Bench of this Court.

Learned counsel for the respondent has filed short reply by way of affidavit of Navdeep Kumar, Additional Managing Director, PRTC, Head Office, Nabha Road, Patiala, on behalf of the respondent, a copy of which has been given to this Court which is taken on record as Mark A and a copy of the same has also been given to learned counsel for the petitioners. Paragraphs 2, 3 and 4 of the said affidavit read as under:- "2.

That with regard to the claim of the petitioners, it is submitted that in terms of concluding Para No. 1 of the order dated 21.02.2025 (Annexure P-5), the petitioners have been converted from Contributory Provident Fund Scheme to the Old Pension Scheme (GPF Scheme) and there GPF will be deducted instead of CPF and benefits under rules shall be granted as per entitlement. Detail of new GPF accounts of the petitioners is placed as annexure R-1.

That it is further submitted that the benefit of ACP Scheme has been granted to the petitioners and their salary have been fixed notionally in terms of concluding Para No. 2 of the order dated 21.02.2025 (Annexure P-5). The detail of the same are attached as Annexure R-1." 4.

That the leave encashment will be paid to the petitioners on their retirement as per concluding Para No. 3 of the order dated 21.02.2025 (Annexure P-5)."

Learned counsel for the respondent has submitted that the relief which the petitioners were entitled to has already been given to the petitioners.

Learned counsel for the petitioners has submitted that in view of the same, the present petition be disposed of but liberty be granted to the petitioners to revive the same in case anything remains outstanding. 5.

Ordered accordingly.

Pending application, if any, stands disposed of in view of the abovesaid order.
