The present appeal pertains to the year 2018 and the same is still at the stage of preliminary hearing inasmuch as notice of motion is yet to be issued. Repeatedly the case had been adjourned on the request of the learned counsel for the appellant on one ground or the other. On 10.05.2022 the following order was passed :

'On 20.01.2020 the following order was passed : "Learned counsel for the appellant prays for time to seek instructions qua the status of the criminal case with regard to the accident."

Learned counsel for the appellant states that he has still no instructions in the matter.

Adjourned sine die with liberty to move an application for hearing of the appeal as and when the instructions are received by the counsel for the appellant'.

Today none has put in appearance on behalf of the appellant despite the matter being called twice since morning despite the counsel having been duly intimated. It appears that the appellant is not interested in pursuing the present appeal.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 4.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
