(ORAL) Through this petition, the petitioner seeks anticipatory bail in case bearing FIR No.54 dated 01.04.2021, registered under Sections 420, 465, 467, 468, 471 and 120-B IPC, at Police Station City-2 Mansa, District Mansa.
Vide order dated 15.12.2021 passed by this Court, the petitioner had been directed to join the investigation. Thereafter, on 28.03.2022, the case was adjourned on the request of the learned counsel for the petitioner.
Today, learned State counsel, on the instructions from ASI Gurjit Singh, submits that despite having been granted the interim protection, the petitioner though has joined the investigation, yet he is not cooperating with the investigating agency. He further submits that the AMAN JAIN 2022.11.17 16:36 I attest to the accuracy and integrity of this order/judgmentt
CRM-M-52273-2021 (O&M) -2petitioner has been declared as a proclaimed offender on 24.12.2021 i.e. after the date when the petitioner was granted the interim protection. The aforesaid fact has not been disputed by the learned counsel for the complainant.
Since, the petitioner has been declared as a proclaimed offender, no further indulgence is required to be granted by this Court. Moreover, the petitioner cannot be allowed to avail the interim protection at the costs of violation of the conditions laid therein. Therefore, the petitioner is no longer entitled to the interim protection.
