The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 16.08.2017 passed by Industrial Tribunal-Cum-Labour Court, Faridabad. 2.

The Labour Court by impugned order dismissed claim of the petitioner on the ground that he was terminated on 31.05.1996 whereas he served demand notice in 2012 i.e. after the expiry of 16 years from the date of termination. There is no explanation for inordinate delay in approaching the Labour Court. Besides that, the petitioner has approached this Court after 07 years from the date of passing order by Labour Court.
