(ORAL) Challenge in the present Letters Patent Appeal is to the judgment dated 12.12.2016 passed by learned Single Judge in CWP-6331-2014 titled as R.P. Sharma vs. Food Corporation of India and others. Learned Single Judge had come to the conclusion that the reduction to a lower stage in time scale of pay for a period not exceeding three years without cumulative effect was not adversely affecting the pension of the employee and the minor penalty and recovery of Rs.2,00,000/- imposed on account of loss caused to the Department was also permissible and both of them could coexist. On 23.03.2022, the following order was passed by this Court:- "Mr. Gupta points out that the Full Bench has also upheld the view which has been taken by the learned Single Judge while answering the reference on 06.12.2019. He has placed on record the said decision.

Proxy counsel for the petitioner prays for a short accommodation. Accordingly, the proceedings are deferred for 27.04.2022."
