Through this petition, the petitioner seeks regular bail in case bearing FIR No.0049 dated 08.05.2021, registered under Sections 147, 148, 149, 323, 341, 506 IPC (Sections 325 and 307 IPC added later on), at Police Station Maloya, District Chandigarh. Learned counsel for the petitioner submits that initially FIR under Section 326 IPC was registered, but later on Sections 307 and 325 IPC were added; that the only allegation against the petitioner is that he had caught hold complainant, namely, Sourabh and that the petitioner has been in custody since 25.07.2021. He further submits that, as far as AMAN JAIN 2022.03.03 17:40 I attest to the accuracy and authenticity of this document

(O&M) -2one other case, registered and/or pending against the petitioner is concerned, the petitioner has already been acquitted in the said case on 22.02.2022.

On the other hand, while opposing the prayer for grant of regular bail to the petitioner, learned State counsel does not dispute the custody period of the petitioner. He, however, submits that the petitioner had actively participated in the occurrence. He further submits that post framing of the charge, prosecution evidence is yet to commence. &
