(ORAL) Both the petitioners herein named Tiwari and Suresh Kumar had sought the relief of anticipatory bail in the criminal case arising out of the FIR bearing No.0176 dated 26.08.2019 registered at Police Station Sector 36 Chandigarh, under Sections 147, 148, 149, 323, 452, 506 read with Section 34 IPC.

Learned counsel for the respondent-UT has forwarded the copy of the Death-Certificate of petitioner No.1 named Tiwari to this Court through "WhatsApp Group for Video Conferencing" and the same is taken on the record. As per the said Certificate, the above-named petitioner died on 01.04.2020.

that in compliance of the order dated 30.09.2019 as passed by the Co-ordinate Bench, petitioner No.2 named Suresh Kumar had joined in the investigation and the Challan has already been presented in the Court and petitioner No.2 is also not involved in any other criminal case of the similar nature.

Keeping in view the above-said submission as made by learned counsel for the respondent-UT, the instant petition is allowed qua petitioner No.2-Suresh Kumar son of Chhote Lal and the relief of interim bail, as extended to him (petitioner No.2) by the Co-ordinate Bench vide the said order dated 30.09.2019, is made absolute.

However, petitioner No.2 shall strictly abide by all the conditions as laid down in Section 438(2) Cr.P.C. (MEENAKSHI I. MEHTA) JUDGE 31.08.2021.
