CM No.2882-C1 of 2016 Applicant seeks condonation of delay of 1303 days in filing the appeal.

Notice of the application to Advocate General, Haryana. On the asking of the court, Sh. Shivendra Swaroop, AAG, Haryana, accepts notice and fairly states that let the delay of 1303 days be

condoned in view of the law laid down by the Hon'ble Supreme Court in Imrat Lal and others Vs. Land Acquisition Collector and others, 2015

After hearing learned counsel for the parties, instant application is allowed for the reasons stated therein. Delay of 1303 days in filing the appeal is condoned. However, in view of the law laid down by the Hon'ble Supreme Court in Imrat Lal's case (supra), applicant shall not be entitled for interest for the delayed period of 1303 days. CM stands disposed of.

Learned counsel for the appellant submits that the instant appeal is squarely covered by the order dated 23.9.2014 passed by this court in RFA No.2174 of 2012 (Savitri Devi Vs. Land Acquisition Collector, Gurgaon and others).

Notice of the appeal to Advocate General, Haryana. On the asking of the court, Sh. Shivendra Swaroop, AAG, Haryana, accepts notice and fairly states that instant appeal is covered by the order passed by this court in Savitri Devi's case (supra). In view of the above said common stand taken by learned counsel for the parties, instant appeal is ordered to be disposed of, in terms of the order dated 23.9.2014 passed by this court in RFA No.2174 of 2012 (Savitri Devi Vs. Land Acquisition Collector, Gurgaon and others). Disposed of, accordingly.
