SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Section 483 of BNSS, 2023 praying for grant of regular bail in case FIR No.95 dated 26.10.2017 under Sections 302,120-B IPC and Sections 25,27 of the Arms Act registered at P.S Kotwali Nabha, District Patiala.

Learned State counsel has furnished a short affidavit of Mandeep Kaur, PPS, DSP, Sub Division Nabha, District Patiala on behalf of respondent in Court today, which is taken on record.

Paras 4 & 5 of the affidavit would reveal that a final report under Section 173 Cr.P.C was presented on 17.01.2018 and the case was committed to the court of Sessions on 02.02.2018. Initially 35 witnesses were shown to have been arrayed by the prosecution in the challan. Subsequently, supplementary challan was presented on 14.12.2023 and charges were framed on 29.11.2024 with four more prosecution witnesses having been arrayed. Be that as it may, learned State counsel informs the Court that out of total 39 prosecution witnesses, 37 have been examined and two are likely to be examined within the next 2-3 days.

Faced with the situation where the trial is almost towards the fag end, learned counsel representing the petitioner prays for withdrawal of the instant petition.

Prayer is accepted.

Dismissed as withdrawn.
