Driver-cum-owner of the vehicle in question has filed the present appeal challenging the award dated 12.10.2017 vide which the respondents were awarded compensation to the extent of 10,13,392/- along ₹ with interest.

It is stated that the vehicle in question was not insured. It has been brought to the notice of this Court that during the pendency of the appeal, the matter has been finally settled before the Mediation and Conciliation Centre of this Court and a settlement/agreement dated 03.11.2025 has been arrived at which has been placed on record of the present case. It has been further brought to the notice of this Court that as per the settlement/agreement, an amount of 5,75,000/- was agreed to be ₹ paid by the present appellant to the respondent as full and final settlement and the said amount has already been paid vide two demand drafts dated 30.10.2025, the details of which have been mentioned in the settlement/ PUNEET SACHDEVA 2025.11.20 15:39 I attest to the accuracy and authenticity of this document Chandigarh

FAO No.753 of 2018 (O&M) agreement. It has jointly been submitted that the said compromise has been entered into voluntarily and without any pressure and that the present appeal be disposed of and the award be modified in terms of the settlement/compromise.

Learned counsel for the respondents-claimants has submitted that as has been agreed, the respondents-claimants would withdraw the execution application filed by them on the next date of hearing. 4.

Keeping in view the abovesaid facts and circumstances, the present appeal is disposed of and the award of the Tribunal is modified as per the terms of the settlement/agreement dated 03.11.2025 and the parties would be bound by the terms of the compromise.
