After arguing at length, the matter has been amicably settled. Under the settlement, the respondents have allowed six months time to the appellant on his request, to vacate and hand over the vacant possession of demised premises subject to the terms as follows:- (i) that the appellant will pay the entire arrears of rent due upto 31.12.2015 within two weeks by depositing the same in Court or making the payment to respondents against receipt;
(ii) that the appellant will keep on paying advance rent of the shop upto June, 2016 on or before 7th of each month and for the month of January, 2016, the rent will be paid by 31.01.2016;
(iii) that the appellant will furnish undertaking before the Court within two weeks to vacate and JITENDER KUMAR 2016.01.18 15:39 I attest to the accuracy and integrity of this document
RSA No. 102 of 2016 -2hand over vacant possession of the shop on or before 15.07.2016.
In case of violation of any of the term indicated above, the executing Court will proceed further to execute the decree without seeking any further orders.
