**** HARNARESH SINGH GILL, J.(Oral) Through this petition, the petitioner seeks issuance of direction to respondent No.4 to either file report under Section 173 Cr.P.C. or the cancellation report in case bearing FIR No.7 dated 23.01.2017, registered under Sections 323, 341, 342, 148 and 149 IPC, at Police Station City Rampura, District Bathinda. Though the petitioner is one of the accused in the present FIR, yet the present petition is being entertained by this Court as the FIR pertains to the year 2017.

Learned counsel for the petitioner has very fairly conceded that the petitioner along with others, are accused in the present FIR. He further submits that as per Section 169 Cr.P.C., when there is no evidence against the alleged accused, then he can be released. Notice of motion to the respondent-State only, at this stage. On the asking of this Court, Mr. Harkanwar Jeet Singh, AAG AMAN JAIN 2022.11.16 17:35 I attest to the accuracy and integrity of this order/judgmentt

CRM-M-48640-2022 (O&M) -2Punjab, accepts notice and he, on the instructions from ASI Gurdev Singh, submits that though the investigation in the present case is still going on, but the same will be concluded within two months from today. In view of the above, the present petition is disposed of with a direction to respondent No.2-Senior Superintendent of Police, Bathinda, District Bathinda, to conclude the investigation in the above noted FIR, within two months from the date of receipt of the certified copy of this order, as per law.

It is kept open to the petitioner that in case, he will still be aggrieved, he would be at liberty to move an appropriate application for revival of the present case.
