(ORAL) Learned counsel for the appellant has submitted that the respondent had filed a petition under Section 9 of the Hindu Marriage Act, 1955 ('Act' for short) which was allowed on 6.1.2018. He has submitted that he has though challenged the said decree but at the same time filed a petition under Section 13 of the Act for seeking decree of divorce. Therefore, this appeal is just contrary to the intention of the appellant who has now filed the petition under Section 13 of the Act. Therefore, counsel for the appellant prays for withdrawal of the appeal. Dismissed as withdrawn.
