This Court vide order dated 15.09.2023, issued notice of motion, however, a perusal of orders passed thereafter reveal that either a request for adjournment had been made or there had been no representation on behalf of the petitioner.

It would be pertinent to reproduce the following orders of the previous dates of hearing i.e. 15.09.2023, 24.11.2023 and 12.01.2024 respectively:- "Prayer in the instant petition is for quashing of FIR No.563 dated 23.11.2022 under Sections 406, 420 and 506 of the IPC registered at Police Station Mahesh Nagar, District Ambala, along with all consequential proceedings arising therefrom on the basis of settlement in pursuance of order dated 03.05.2023 (Annexure P-5) passed by this Court in CRM-M-3349-2023.

CRM-M-46388-2023 -2Learned counsel appearing for the petitioners submits that subsequent to the registration of the FIR in question the parties with the intervention of the respectables have amicably resolved all their disputes, and hence continuation of criminal proceedings would serve no useful purpose. Notice of motion for 24.11.2023."

"Learned counsel appearing for the petitioner prays for an adjournment as arguing counsel is in personal difficulty. On his request, adjourned to 12.01.2024."

"Case has been called twice, however, even on second call there is no representation on behalf of the petitioners. In the interest of justice, adjourned to 23.04.2024." 4.

It is, thus, evident that the case is being adjourned time and again. It appears that the petitioners are not interested in pursuing the matter any further.

Dismissed for non-prosecution.
