Counsel for respondent No.1 submits that civil suit No.7272018, titled 'Bant Singh @ Balwant Singh vs. Atma Singh (since deceased) through LRs and another', filed at the instance of the petitioner, on the basis whereof, objections were filed before the Executing Court, has since been decided by learned trial Court and therefore, the present revision petition, as such, be dismissed as having become infructuous. However, none has appeared on behalf of the petitioner today. From the perusal of the paperbook, it is evident that the impugned order is dated 19.08.2021, vide which, the objections raised at the instance of the petitioner, who is JD No.2, were dismissed by the Executing Court. CR-3377-2021 -2plea taken therein, as evident from the impugned order is about the fact of the civil suit, having filed at his instance, to challenge the preliminary decree and final decree, executed between the parties. It was also observed that Balwant Singh was party to all the proceedings, relating to preliminary decree as well as final decree. Also, it has been brought to the notice of this Court that civil suit No.727-2018, on the basis whereof, objections were filed, has since been dismissed by learned trial Court, vide judgment dated 19.12.2024. A copy of the judgment has been placed on record by learned counsel for respondent No.1.

Considering the aforesaid factual position, more particularly, when the petitioner has not come forward, to pursue the revision petition, the same is hereby dismissed as having become infructuous.
