**** JAISHREE THAKUR, J. (ORAL) Notice of motion was issued to the respondents by an order dated 31.03.2016. Subsequently, the matter was taken up on 06.02.2018, when no one put in appearance for the appellant. Co-ordinate Bench noted that on account of non-compliance, notice could not be issued. Despite the fact that there was no representation on behalf of the appellant, it was ordered that process fee be filed within a week and notices be issued to the respondents for 20.09.2018.

As per the office report, notices could not be issued to the respondents as learned counsel for the appellant has not filed the process fee.

Even today case called twice and it is already 3.30 p.m., there is no one who is present to represent the appellant and it is also noted that process fee has not been filed as on date.
