This petition has been filed for regular bail under Section 483 of BNSS in case FIR No.151 dated 18.05.2025 under Sections 20-B and 27-A (Act No. 61) of Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 61 of Excise Act, registered at Police Station Bhuna, District Fatehabad.

Learned counsel for the petitioner submits that the case of the prosecution is that the petitioner has been implicated on the basis of disclosure statement of the co-accused namely Gaurav Kumar, from whose possession 8 Kgs and 500 grams of Ganja and 140 bottles of country made liquor has been recovered. The petitioner is in custody since 20.05.2025. He submits that the FSL report is not filed.

As per custody certificate dated 04.08.2025 the petitioner is in custody for 02 months and 15 days and he is involved in two more cases under the NDPS Act, 1985, however, he is on bail in those cases. He further submits that FSL report is still awaited and the case is under investigation.

I have heard the learned counsel for the parties and perused the record.

In view of the statement of the learned State counsel, this petition is allowed. In the meanwhile, the petitioner is granted concession of interim bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned till the filing of FSL report. The petitioner is directed to surrender before the trial Court concerned and seek regular bail, when the FSL report is received and supplementary challan is prepared. (H.S.GREWAL) 05.08.2025.
