The substantive prayer made in the petition reads thus: 'In the light of the aforementioned facts and circumstances, it is, therefore, respectfully prayed that the directions to the respondent no. 2 to 5 may kindly be issued to take prompt and necessary action against respondent no. 6 & 7 and ensure fair and impartial investigation in FIR No. 149 dated 06.12.2024 under Section 115(2), 3(5), 126(2) and 296 of Bhartiya Nyaya Sanhita, 2023 registered at Police Station Smalsar, in the interest of Justice, Equity and fair Play.'

Upon being called upon, the State has filed reply by way of affidavit of Dalbir Singh, PPS, Deputy Superintendent of Police, Baghapurana, District Moga, relevant portion whereof reads thus: 'That said investigation report has already been approved by the Senior Superintendent of Police, Moga on 14.08.2025 and cancellation reports in version and cross version will be presented before the Ld. Court after completion of formalities.'

CRM-M No.41575 of 2025 -23. Further, learned State counsel (on instructions from ASI Sukhwinder Singh) has brought to the notice of this Court that the said cancellation report has been submitted by the police before the concerned Court on 18.9.2025.

Faced with the situation, learned counsel appearing for the petitioner seeks to withdraw the petition in hand with liberty to avail his remedy in accordance with law before the concerned Court where the said cancellation report is pending adjudication.

Disposed of with the liberty aforesaid.
