**** VINOD S. BHARDWAJ J. (ORAL) The present petition has been filed for seeking direction to respondents to provide adequate security to the petitioner, who is apprehanding threat to his life and liberty.

Status report by way of an affidavit of Swarndeep Singh, Senior Superintendent of Police, Jalandhar (Rural) has been filed. The relevant extract thereof reads thus :

"That in regard to the same, his threat perception was forwarded to the ADGP (Security), Punjab, Chandigarh, being the Nodal Head, as the final decision with regard to the providing security to an individual lies with the ADGP (Security), Punjab, Chandigarh, in accordance with law. 5.

That it is respectfully submitted that in regard to the threat to the petitioner, a letter No. 42159/DDSB-4 dated

2 2023:PHHC:139985 01.09.2022 was received from the office of ADGP (Security), Punjab Chandigarh, with a direction to the Senior Superintendent of Police, Jalandhar (Rural) i.e. the deponent, to provide area security to the petitioner namely Amrit Kumar Bhakri.

That it is respectfully submitted that, keeping in view the protection and security of the petitioner and in compliance with the aforesaid directions, the area security was provided and Daily Patrol/PCR Team was deployed in the area where the petitioner resides.

Thereafter, keeping in view the protection of the Petitioner and fresh inputs, it was recommended by the office of Senior Superintendent of Police, Jalandhar (Rural) i.e. the deponent, to provide Security Guard to the Petitioner and recommendation was sent to the ADGP (Security), Punjab, Chandigarh for approval.

Thereafter, the approval was received and the present petitioner was provided with one security guard and the one security guard is still deployed with the present petitioner, keeping in view the security of the life and liberty of the present petitioner.

That, it is pertinent to mention here that the petitioner had submitted a representation No. 510/5/BH dated 15.08.2022, before the Deputy Superintendent of Police, SubDivision Phillaur, regarding receiving threats to kill from unknown persons also. That on the basis of the aforesaid representation, FIR No. 228 dated 18.08.2022 under Section 506 IPC and Section 25/54/59 Arms Act was registered at Police Station Phillaur, Jalandhar (Rural), on the complaint of Petitioner Amrit Kumar Bhakri.

That it is respectfully submitted that the present threat perception of the petitioner Amrit Kumar Bhakri is being analyzed from time to time and the needful will be done in accordance with law in case any inputs are received regarding

That as already stated above the area security/patrolling/PCR has been deployed near the residence of the Petitioner and one gunman has already been provided to him. Therefore, the needful has been done regarding the threat to the life and liberty of the Petitioner, in accordance with law."

It is, thus, evident that the assessment of threat to the petitioner has already been undertaken by the competent authority and the security has been provided.

Even the abovesaid status report has been filed on 16.02.2023 and no rejoinder disputing the same has been filed by the petitioner till date. Hence, the averment made in the status report remains undisputed and uncontroverted. The present petition is accordingly disposed of as having been rendered infructuous.
