Prayer in the present Writ Petition filed under Article 226 of the Constitution of India is for issuance of a writ in the nature of Certiorari for setting aside the award dated 08.09.2021 (Annexure P-1) passed by the Presiding Officer, Industrial Tribunal-cum-Labour Court-I, Gurugram (Respondent No.1).

Learned counsel for the parties are ad idem that the matter has been amicably settled between the parties. As per the Settlement Agreement, learned counsel for the petitioners has handed over a demand draft (in original) bearing No.606385 amounting to Rs.9,48,150/- in the name of Raj Kumar Verma (respondent No.3), drawn on The Hongkong and Shanghai Banking Corporation Limited to respondent No.3, who is present in the Court and has been duly identified by his counsel. A photocopy thereof has been placed on record, subject to all just exceptions.

Learned counsel for the petitioners submits that in view of the amicable settlement between the parties, he may be permitted to withdraw the instant petition, however, he prays for release of an amount of Rs.4,74,075/- so deposited by the petitioners, pursuant to order dated 23.12.2021 passed by this Court.

Learned counsel for respondent No.3 has not raised any objection to the said course of action.

Since the matter between the parties has been amicably settled; accordingly, the Registrar (Judicial) of this Court shall release the said amount of Rs.4,74,075/- to the petitioner, henceforth. Parties to remain bound by the terms of compromise.

Disposed of in the aforesaid terms.
