Tribhuvan Dahiya, J (Oral) This judgment shall dispose of afore-mentioned two petitions as they arise of same impugned order, and involve similar questions of law and facts.
These revision petitions have been filed under Article 227 of the Constitution of India for setting aside Order dated 26.09.2022, whereby the suit filed by the respondent-plaintiff has been dismissed as withdrawn. It was further ordered that Court fee be refunded to the plaintiff as per rules. AVIN KUMAR 2022.10.27 17:39 I attest to the accuracy and integrity of this document
CR No.4689 of 2022 [2] The plaintiff had made a statement to the effect that he did not wish to pursue the present suit due to some technical mistake and wanted to withdraw the same. On his statement, the trial Court dismissed the suit as withdrawn and liberty was granted, if the law so permitted. No ground is made out to interfere with the impugned order. Dismissed.
