Present appeal is directed against the judgment dated 07.12.2017 passed by the Addl. Civil Judge (Sr. Div.), Ferozepur vide which the petition under Section 9 of the Hindu Marriage Act (for short 'the Act') filed by the respondent-wife was dismissed. During the pendency of appeal, learned counsel for the appellant had moved an application for converting the present appeal into a petition under Section 13-B of the Act seeking divorce by mutual consent. The prayer was allowed vide order dated 15.07.2019 and the statement of first motion stage was recorded separately. Thereafter, the matter was adjourned to 19.09.2019.

Both the parties are present in court today. Their statements at second motion stage have been recorded separately. Both the parties stand by their statement made at first motion. FAO-M-153-2018 -2of two separate demand drafts have been handed over to the respondent in settlement of all claims. Both the parties agree that their marriage be dissolved by invoking the provisions of Section 13-B of the Act. In view of the fact that the parties have decided to part ways, we hereby accept their prayer for dissolution of marriage. It is directed that the marriage between them is dissolved by a decree of divorce. Appeal is allowed and the Decree-sheet be prepared accordingly. At this stage, it has been pointed out that an amount of Rs.11 lakhs by way of drafts had been deposited in the Registry at the time of first motion. Respondent shall be at liberty to withdraw the same by moving an appropriate application before the Registry.
