Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Sonu Kumar in case FIR No. 65 dated 04.04.2017, registered under Section(s) 279 & 304-A IPC at Police Station Sadar, Yamuna Nagar, District Yamuna Nagar.

Learned counsel for the petitioner contended that earlier, petitioner was admitted to bail, but it was cancelled on 18.07.2018 by the learned Judicial Magistrate Ist Class, Yamuna Nagar as he failed to put in appearance on the said date. Learned counsel further contended that on the date prior to 18.07.2018 i.e. 06.02.2018, there were two cases titled "State v. Sonu" fixed before the learned trial Court; petitioner mistook the date and as such, he could not appear before the learned trial Judge on 18.07.2018. Having considered the submissions made by learned counsel for the petitioner and perused the record, this Court is of the considered view that petitioner has not been to satisfy the Court that how he failed to put in DEEPAK KUMAR BHARDWAJ 2019.09.27 14:52 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-41727 of 2019 appearance before the learned trial Court on any date after 18.07.2018 during long period of more than one year.

In view of above, no case is made out to grant the concession of pre-arrest bail to the petitioner and as such, present petition stands dismissed.
