**** RAJAN GUPTA, J. (Oral) Learned counsel for the parties has apprised the court that during the pendency of the appeal, parties have arrived at a compromise. According to them, both the appellant and respondent are present in court today and wish to file a joint affidavit. Prayer is accepted and affidavit is taken on record. They undertake to adhere to all the terms and conditions of the settlement. In view of above, counsel for appellant submits that no cause of action survives in the appeal. He may, thus, be allowed to withdraw the instant appeal. Counsel for the respondent has no objection.
