The petitioner seeks grant of parole so as to attend the 'Bhaat' ceremony of his niece, which is to take place on 4.11.2022 at District Palwal. 2.

Short reply by way of an affidavit of Shri Anil Kumar, Deputy Superintendent, District Jail, Faridabad has been filed by learned State counsel, which is taken on record.

In the reply filed by State today, the factum of marriage of petitioner's niece has been admitted. However, the stand taken by the State is that the petitioner has already exhausted the permissbile 10 weeks of parole during a calender year. It has also been stated in the reply that on one occasion, when the petitioner had been released on parole, he committed another offence in respect of which FIR No.94, dated 9.4.2021, Police Station Sadar Palwal, under Sections 420, 120-B and 506 of Indian Penal Code was lodged. This Court has considered the rival submissions. 5.

Having regard to the above mentioned facts and circumstances, the instant petition is accepted to the limited extent that the petitioner is permitted to attend the 'Bhaat' ceremony in respect of marriage of his niece, which is stated to be solemnized on 4.11.2022 at District Palwal. However, the petitioner shall be taken to the said place in police custody in the morning of 4.11.2022 and shall be consigned back to jail on the evening of said date subject to the condition that the petitioner shall bear the requisite expenses for his transportation etc.
