Learned counsel submits that the pendency of the appeal against the judgment dated 24.11.2022, whereby the petitioner stands acquitted, cannot be made basis of not issuing the PCC certificate. Grave prejudice is being caused to him as he is not being confirmed in service and benefits accruing therefrom have been withheld, despite the fact that he was granted regularisation wayback in 2014, the year, in which the said FIR was registered. 2.

In view of the aforesaid fact, learned State counsel while referring to para 12 of the short reply dated 06.05.2024 filed by way of affidavit of Deputy Superintendent of Police, Sub-Division City, Pathankot states that since the DDA (Legal) has given an opinion in favour as reproduced in para 11, in case, the petitioner applies for PCC again, the same shall be considered in accordance with law and needful will be done within a period of 4 weeks, which satisfies the learned counsel for the petitioner.
