M.M.S. BEDI, J. (ORAL) Counsel for the appellant submits that as per his instructions, the appellant who is staying in Italy is not interested in pursuing the present appeal.

It is not out of place to observe here that a sum of Rs.25,000/- ordered to be paid by the appellant to the respondent towards interim litigation expenses has also not been paid. The appeal deserves to be dismissed solely on that ground also.
