(ORAL) The appellant has come up in this appeal against the judgment and decree dated 30.07.2018 passed by the Additional District Judge, Kurukshetra, whereby his petition under Section 13 of the Hindu Marriage Act, 1955 (for short 'the HMA') for dissolution of marriage by a decree of divorce has been dismissed.
Today, appellant and respondent along with her father-Naresh Chand Garg are present in Court. Respondent, after discussing the matter with her father, states that she is ready to take divorce from the appellant under Section 13-B of the HMA without claiming any permanent alimony. Both the parties have agreed that this appeal may be converted into petition under Section 13-B of the HMA. -2FAO-M-269 of 2018 have been recorded in this regard today in Court. Perusal of file shows that marriage between the parties was solemnized on 27.06.2012. No child was born out from the wedlock. The parties are living separately from each other for the last nineteen years. In view of the above, this appeal is converted into petition under Section 13-B of the HMA. Petition is allowed. Marriage between the parties is dissolved and impugned judgment and decree dated 30.07.2018 is hereby set aside.
Decree-sheet be prepared, accordingly.
