By way of filing the present application, the applicant/petitioner seeks permission to correct inadvertent error/omission in FIR No.272, dated 27.12.2008 registered at Police Station Phillaur, District Jalandhar under Sections 323, 324, 148 and 149 Indian Penal Code, wherein offence under Section 326 IPC was added later on.

Today, at the very outset, learned counsel representing the applicant/petitioner submits that he may be permitted to withdraw the main petition i.e. CRM-M41876-2019 itself with liberty to file two separate petitions i.e. one for assailing the order vide which the applicant/petitioner was declared a proclaimed offender and the other for quashing of the FIR. In view of the specific prayer made by learned counsel for the applicant/petitioner for withdrawal of the main case, the main case i.e. CRMM-41876-2019, which stands admitted vide order dated 7.12.2023, is preponed and is taken on board today and the main case itself is hereby dismissed as withdrawn with liberty aforesaid. 4.
It is however noticed that the following order was passed on 23.8.2023: "Learned counsel for the petitioner submits that the petitioner will surrender before the trial Court within a period of one and a half month.
In case the petitioner does so and moves appropriate application before the trial Court, he shall be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
This will be subject to deposit of costs of Rs.25,000/- with 'Poor Patient Welfare Fund', PGIMER, Sector, 12, Chandigarh, which shall be a condition precedent to the release of the petitioner List on 11.10.2023."
